On July 1, 2025, Louisiana became the 11th state to enact a dedicated regulatory framework for the earned wage access (EWA) industry. This follows the passage of HB 368, the Louisiana Earned Wage Access Services Act, on June 4, 2025, that passed with broad, bipartisan support.
Louisiana joins California, Maryland, Arkansas, Indiana, Kansas, Missouri, Nevada, South Carolina, Utah, and Wisconsin in creating a distinct regulatory framework for EWA providers.
The new law creates definitions and consumer protections for EWA in the state and requires annual data reporting by providers to the Office of Financial Institutions. Payactiv is already compliant with these requirements, and no product changes are required for Payactiv’s product or employer partners.
Payactiv congratulates Representative St. Blanc on sponsoring the bill, as well as House and Senate leaders on taking this important step to promote safe and innovative financial services that improve the lives of hard-working Louisianans.
